THE ANDY BIGGS FILES, VOLUME 2: Tripling Down on Spousal Rape Vote

Welcome to The Andy Biggs Files, Copper State War Room’s weekly look at Andy Biggs’ decades-long record of protecting pedophiles, sex traffickers, and abusers.

Each week, we’ll examine a different vote from Biggs’ career, what was at stake, and explain how he put politics ahead of protecting Arizonans.

Volume 2 focuses on 2005, when Biggs voted against a 52-5 bipartisan majority to oppose raising the penalty for spousal rape to equal that of other forms of rape. 

The bill Biggs voted against, SB 1040, would have made spousal rape a Class 2 felony — the same level as other rape charges. At the time, spousal rape was only a Class 6 felony, meaning offenders could serve no jail time at all. 

In October 2025, he doubled down on this vote during "Politics Unplugged," dismissing the question as "political meat" and claiming "nobody is asking me about that." Last week, Biggs was asked about this vote and tripled down on it, at one point asking, “Can you tell me how many charges of spousal rape have we had?” before getting into a verbal altercation with 12News' Brahm Resnik. 

This vote is one in a long pattern of Biggs being on the wrong side of legislation intended to protect women and children from sexual abuse, exploitation, and trafficking that is documented in The Andy Biggs Files, a website released earlier this month examining Biggs’ legislative record on these issues.
